IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM. BY CREATING AN ACCOUNT, ACCESSING, OR USING ANY PART OF THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY.

1. Introduction and Acceptance

Welcome to REMCAN Realers ("Platform", "Service", "we", "us", or "our"). REMCAN Realers is a real estate agent verification and credentialing platform operating in the Federal Republic of Nigeria. By accessing or using our Platform, you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms").

2. Key Definitions

  • Realer: A real estate agent or professional using the Platform for verification and credentialing
  • REMCAN Realer ID: The unique identification number assigned to verified Realers
  • Tier 1: Basic unverified user profile status
  • Tier 2: Fully verified user status with REMCAN Realer ID credential
  • Biometric Data: Face scan images and liveness detection data collected during verification

3. Eligibility Requirements

To use the Platform, you must:

  • Be at least 18 years of age
  • Be a resident of Nigeria or authorized to conduct real estate business in Nigeria
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Platform under Nigerian law
  • Not have been previously suspended or banned from the Platform

4. Verification Process

The verification process consists of five mandatory stages:

  1. Profile Information (name, bio, specialties, experience)
  2. Location Verification (GPS coordinates, state of operation)
  3. Biometric Verification (live face scan with liveness detection)
  4. Document Submission (government-issued ID)
  5. Review and Approval (administrative review and fraud screening)

5. Acceptable Use Policy

You agree NOT to:

  • Provide false, misleading, or fraudulent information
  • Impersonate another person or entity
  • Create multiple accounts
  • Attempt to gain unauthorized access to the Platform
  • Scrape, harvest, or collect user data without authorization
  • Harass, threaten, or intimidate other users
  • Violate any applicable Nigerian laws or regulations

6. Fraud Prevention and Law Enforcement Cooperation

⚠️ ZERO TOLERANCE FRAUD POLICY

REMCAN Realers maintains a strict zero-tolerance policy toward fraudulent activity, identity theft, and misrepresentation. Violations will result in immediate account termination and law enforcement referral.

6.1 Prohibited Fraudulent Activities

The following activities constitute fraud and are strictly prohibited:

  • Submitting false, forged, or altered identity documents
  • Using another person's identity, credentials, or personal information
  • Providing fraudulent professional qualifications or experience
  • Misrepresenting your identity, location, or business operations
  • Using the Platform to facilitate real estate scams or fraudulent transactions
  • Impersonating verified Realers or REMCAN officials
  • Creating fake profiles or multiple accounts to deceive users
  • Manipulating or circumventing verification processes

6.2 Consequences of Fraudulent Activity

If you are found to have engaged in fraudulent activity, provided false information, or attempted to defraud other users of this Platform, the following actions will be taken:

Immediate Account Termination

Your account will be permanently suspended without prior notice, and all credentials will be revoked.

Law Enforcement Referral

Your personal information, account details, and evidence of fraudulent activity will be reported to and shared with appropriate Nigerian law enforcement authorities, including but not limited to the Nigerian Police Force, Economic and Financial Crimes Commission (EFCC), and other relevant agencies for investigation and potential prosecution.

Public Record and Blacklist

Your details may be added to our fraud prevention database and shared with industry partners to prevent future fraudulent activity across the real estate sector.

Civil and Criminal Liability

You may face civil lawsuits for damages and criminal prosecution under Nigerian law, including charges of fraud, identity theft, forgery, and obtaining by false pretense.

Permanent Ban

You will be permanently banned from creating new accounts or accessing the Platform in the future.

6.3 Cooperation with Authorities

REMCAN Realers fully cooperates with law enforcement agencies in the investigation and prosecution of fraudulent activities. We will:

  • Preserve and provide all relevant account data, communications, and evidence
  • Respond promptly to lawful requests for information from authorities
  • Assist in the identification and location of suspected fraudsters
  • Testify in legal proceedings when required
  • Share information with other platforms and industry bodies to prevent fraud

6.4 Reporting Suspected Fraud

If you suspect fraudulent activity or encounter a user engaging in deceptive practices, please report immediately:

⚖️ Legal Notice

By using this Platform, you acknowledge that fraudulent activity is a serious criminal offense under Nigerian law and may result in imprisonment, fines, and a permanent criminal record. You agree to provide truthful and accurate information at all times.

7. Privacy and Data Protection

Our Privacy Policy is incorporated into these Terms by reference. We collect and process personal data including account information, biometric data, identity documents, and location data. For complete details, please review our Privacy Policy.

8. Disclaimers and Limitations

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee absolute accuracy of verification results or prevention of all fraudulent activity. Our total liability shall not exceed ₦50,000 (Fifty Thousand Naira) or the amount you paid in the preceding 12 months.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nigeria.
